It blows me away that a borrower can be late on the very first payment! Sigh. I sure hope that his group leader and "friend" are hopping on this one.

I agree you lend money to these people and they can't even make the first payment. It interesting to read how they will pay the Prosper loan and then this happens.

What really chaffs me is that this was encorsed by a group leader who obviously did not do his homework. When checking, the city that the borrower put down is not even a valid city. There is no Chandler NC. That is the purpose of a group leader -- to check out part of what the borrower is saying. They get paid 1% to do less than nothing. They not only did not do their job, they misled the lenders and should be banned from being a group leader in my opinion!

| There is a Candler, NC though--just west of Asheville. As far as the group leader endorsement, notice that this guy is just another one of those large groups more interested in rewards than having a good group. His interest was obvious from the beginning to have a big group to make money from GL fees. |

I ALSO SEE HE SAID HE HAS SOME ON THIS LISTING BUT SEARCHE AND WA UNABLE TO FIND HIS BID. i HAVE REFUSED TO BID ON ANY LOAN FROM THIS GROUP BECAUSE HE TAKES LEADER FEES AND WAS UNHELFUL WHEN I WAS A BORROWER. |

I do take it back. I must have misspelled my search on mapquest for Chandler. Thanks for relieving my mind. It just seemed to be such a set-up. When the first payment was missed, I wrote the group leader and the "friend" to see if something was being done. There was no response from either one. I was just extra irritated because I mistakenly bid twice and had twice as much money on this single loan as any of my others, and then it immediately defaults. So, I did a search for Michael Peyton Gunn in chandler and there was no such thing. Sigh.
There are public records for Michael Gunn in Browns Summit NC, as well as a Michael Gunn in Monroe NC. I did not pay to find out what the public records are.
Oh well. It just renews my vow to never big on anybody with a deliquency no matter what excuse they have. It has been the one defining trait that makes a difference on whether they will pay this bill on time too. Thanks for letting me vent. |

| I can't get over my anger on this one. How can a person borrow $25,000 and not make one payment and not have it be fraud? Actions show that there was no intent to ever pay it off, or even make a payment, only to steal the money. Why can Prosper not do anything about this sort of abuse? |

| I didn't bid on this loan, but I never trust loans with automatic close. This loan made no sense to have a 'C' rating and not try to bid down from 28%. That's tells me I don't care, I'm not paying it back anyway. I know some lenders that only bid on automatic close loans. I've learn my lessons the hard way. And was I could set up SO's to exclude business loans. |

Since Ilive in NC and am willing to haul him into small claims court just for the fun of it, does any one know if we can do that based upon the prosper loan. I have been in smallclaims court (and distric court) several times and don't mind at all doing it again. Maybe it would be come kind of test case for propser lenders taking into court a dead beat or two.

So, are we allowed to contact him? Surely it is not harrassment if a person owed you a debt and you contact them to see if they will pay? I know that Prosper has their own rules against it, but how about legalities?

I think that Prosper takes it's stand because some hot headed lenders will cross the line. The Fair Credit Collections Act (google it) states what you expect to be fair. Example We can not threaten to sue unless we plan to. But we can contact them.
What I want to do is sue him and do it with a group of lenders who sign up and are willing to pay some small expences. In NC a case can be filed for $105 and the Sheriff will do the servings. Most of the early work can be done by Mail. ( I have done all this before and am involved in two suits, one in Union and one in Mechlenburg Co. I am not a lawyer, but Ido know the Law in this case. What I need is premission from Prosper to sue and helpform other lenders. One plan would be for me to purchase this and other NC Loans from Prosper and collect everything for myself. I do not want that roure, I want the Court to see the small inverster being screwed by this fellow. |
